OFFICIAL RULES

1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS SUBJECT TO ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS, ORDINANCES AND REGULATIONS. VOID WHERE PROHIBITED OR RESTRICTED.
2. ELIGIBILITY: The Great Gas Giveaway contest is open to residents of Albany, Rensselaer, Saratoga, Schenectady, Schoharie, Columbia, Fulton, Greene, Hamilton, Montgomery, Warren and Washington counties in New York, as well as Bennington County in Vermont and Berkshire County in Massachussets, who are 18 years of age or older as of May 5, 2008. Current and former full-time or part-time employees of WCWN/WRGB/Freedom Broadcasting of New York, Inc., their affiliates, their advertising agencies and promotional companies involved in this promotion, their agents, families, successors and assignees, and current employees of all radio, television or cable TV facilities in the Capital District television DMA and their immediate families residing in the same household, are not eligible to participate. Definition of immediate family members to include husband, wife, mother, father, brother, sister, and grandparents, or as defined and deemed appropriate solely by WCWN.
3. SWEEPSTAKES PERIOD: The Sweepstakes begins at 8:00 p.m. Monday May 5, 2008 and concludes at 10:00 p.m. on Friday, May 30th, 2008.
4. HOW THE SWEEPSTAKES IS PLAYED: Every weekday evening from May 5th 2008 through May 30th, 2008 WCWN will broadcast and display on the television screen a secret keyword between 8:00pm and 10:00pm. This broadcast will take place once each evening. When the viewer sees the keyword they can logon to cwalbany.com and enter the keyword as well as contact information. All information must be filled out in the entry form box on cwalbany.com. Alternatively, contestants can send an entry form with the name of the sweepstakes, their name, address, DOB, home phone number and alternate number to be used as a form of entry. Entries received via mail will be entered in the drawing on the evening that they are received (for example, an entry that is received on 5/7 by WCWN will become part of the 5/7 drawings for the prize of that day). One entry per person per day. One winner will be selected at random each day. Contest runs Monday thru Friday for a total of one (1) winner per weekday will receive one (1) $50 Gas card. A total of twenty (20) winners will be chosen during the contesting period.
For grand prize winners, in order to win and receive their $50 gas card, must sign an Affidavit of Eligibility, a sweepstakes prize acknowledgment and release and must provide their Social Security number and other information as may be necessary for tax reporting purposes, and consent to the use of their name, voice, likeness and picture for general advertising, public relations and promotional purposes for WCWN for a period of one year without further compensation at the time their prize is claimed and received.
5. MISSED OR CANCELLED BROADCASTS: If, for any reason, the keywords are not broadcast during the 8:00pm-10:00pm time slots, the watch and win promotion is cancelled for that day.
6. RESTRICTIONS ON ENTRIES: Only one Prize winner permitted per household during the duration of the contests. The definition of households shall be determined at the sole discretion of WCWN.
7. CLAIMING PRIZES: Daily Qualifying Prizes will be awarded within a week after notifying the winner and the Grand Prize Winners. Winners may come to the WCWN studios at 1400 Balltown Road in Schenectady, NY during normal business hours (8:30am-5:30pm) to claim their prizes. At the winner’s option, WCWN can also mail the prize to the winner’s specified address. Winning contestants must present proof of identity in order to win and receive the prize.
Any prizes not claimed by August 15, 2008, will be forfeited and remain the property of WCWN.
8. LIMITATIONS ON PRIZES: The prizes to be awarded in this sweepstakes are not transferable and no substitution of prizes or winners is permitted. All taxes and other expenses in connection with the prizes are the responsibility of the prize winners. All prizes that have not been claimed by contestants, as set out herein, shall not be awarded and shall remain the property of WCWN.
9. NAME OF WINNERS: The names of all Grand Prize winners will be posted on WCWN’s Web site after the contest period at cwalbany.com, and names and faces may be used in any on-air promotion to promote the contest for up to one year. Names of all winners are available upon request by sending a stamped, self-addressed envelope to “WCWN Great Gas Giveaway,” WCWN, 1400 Balltown Road, Schenectady, NY, 12309. Requests must be received prior to January 30, 2009.
10. ODDS: Odds of winning depend on number of eligible contestants who play the game. Secret words will be aired once a day. Secret words will be changed everyday during the contest period (5/5/08-5/30/08).
11. SPONSOR: By participating in this Sweepstakes, contestants agree to be bound by these Official Rules and by all decisions of the Sponsor, WCWN. All decisions of WCWN relating to the administration of this contest, including, without limitation, decisions relating to the eligibility of contestants, the award of the prizes, and the interpretation of these Official Rules, shall be final and binding in all respects. WCWN will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other contest materials. WCWN reserves the right in its sole discretion to suspend, modify or terminate this contest if necessary to comply with any federal, state or local law, ordinance or regulation, or if WCWN determines in its sole discretion that the integrity of the contest has been compromised by fraud, tampering, unauthorized human intervention or other causes beyond the reasonable control of WCWN which threaten to corrupt or impair the administration, security, fairness or proper operation of the Sweepstakes.
12. LIMITATIONS OF LIABILITY: By participating in the contest, contestants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the contest, or any prize awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased, and any other damages, other than damages for actual out-of-pocket expenses.
13. CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision. In the event any such provision is determined to be invalid or unenforceable, the balance of these rules shall remain in full force and effect as if the invalid or unenforceable provision was not contained herein.
14. GENERAL RELEASE: By participating in the Contest, contestants release WCWN/Freedom Broadcasting of New York Inc., any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the contest (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
